Personal Injury Law – Auto Accidents
Every year, more than 6 million accidents occur that result in injuring nearly 3 million people. Car accidents are among the leading causes of personal injury and death in the State of Texas. There are so many causes of car accidents in Texas, and it is important to take the right steps after getting involved in a car accident. As one of an experienced team of car accident attorneys, we have worked on car accidents cases across Texas and represented clients in getting the maximum compensation for their damages. Over the years our attorneys have recovered millions for our clients and helped them get compensation for medical bills, property repair and replacement, loss of income, disability, and much more. We have put together a list of things that every accident victim needs to remember in a car accident:
*Make sure everyone in your vehicle is OKAY – Before determining the size and scope of property damage, you should make sure that everyone else involved in the accident is okay.
*Pull your vehicle over to the side of the road if possible – Pull your vehicle over to the side of the road in the safest manner possible and never leave the scene of a car accident until it is appropriate to do so. You may face tremendously severe criminal penalties if you leave the scene of an accident, especially if someone has sustained injuries or has been killed.
*Call the police and notify them of the accident immediately – If the accident resulted in serious property damage, physical injuries, or death, it is very important that you call the police. In addition, you should ask for a police report to be filed if police officers arrive at the scene, and acquire the names and badge numbers of any responding police officers.
*Call for an ambulance if you or your passengers feel any pain – If any of the passengers feel pain, it is advised that you seek out paramedics immediately. If anyone is unconscious or dealing with neck and back pain, it is in your best interest not to move them until qualified medical personal arrives.
*Have your information (license, insurance, registration) ready for the police – Talk to the other drivers of the other vehicles involved in the accident in order to exchange names, drivers license numbers, phone numbers, addresses, license plate numbers, and basic insurance information.
*Do not discuss the accident with the other party, but take notes if they discuss it with you – Attempt to be cooperative with other drivers in determining whether everyone is okay; however, never discuss the accident with them in order to not back yourself into a corner in terms of legal liability.
*Pay special attention if the other driver had been drinking or was otherwise impaired (i.e., eating/drinking in the car or on their cell phone) – Note if the other parties had food or drink around them at the time of the accident or if they smelled like alcohol.
*Stop any witnesses and get their contact information. Ask the witnesses what they observed and ask them to wait for the police to arrive so that they can give their statement to the police. If they do not want to wait, get their license plate information – Ask witnesses what they were able to see. Get their names, addresses, and telephone numbers if it is possible.
*Take photographs of your vehicle and of the other vehicle if possible. Also, take photographs of road obstructions, if any. – Take photographic proof of all damages resulting from the accident as soon as possible after the accident in order to help insurance adjusters determine the compensation needed for the damages to the car in addition to assisting your case in court.
*If you do not go to the hospital, visit your family doctor or another provider that same day, if possible – Seek out medical attention the same day of the accident in order to ensure your health after the accident. Many times the shock from the accident will suppress injuries for some time after an accident causing a victim to be unaware of any injuries they may have sustained.
*Consider hiring an attorney – If anyone involved in the accident sustained any form of injuries, it is best advised that you consult with a car accident attorney in order to help maximize your recovery from injuries and better defend yourself if you were at fault. *Avoid early settlement offers – Many times insurance providers will offer an initial settlement that does not adequately cover the expenses resulting from an accident. It is in your best interests that you consult with our attorney on these matters in order to ensure that all of your expenses are adequately compensated.
